Tracy and her husband received the slaves in N.C., but sometime after her father's death, they moved to Wilson Co., TN bringing with them the two slaves and their increase. Tracy and her husband are still living in Wilson County, but are now very old being something over 70 years of age.... The said girl Hasty has as your Orators are informed, twenty one children, a portion of whom are now in the possession of the defdts. the others have been carried away to other states perhaps.... Henry SMITH has girl Hasty and the following named children of said Hasty, to wit: Jacob, Jane, Paralee, Huston, Leionidus, Hannah, Harriet, John and Tabby - Henry got said Hasty and several of her children from his father, who purchased Hasty and some of the others at the sale. Several children of Hasty have been sold ... one by the name of Charles.... Dr. J.M. SMITH has one of Hasty's children named Lewis, but how he got him cannot state.... Joseph SMITH has in his possession a girl named Emeline a dau. of Hasty and the defdt. 15 Apr. 1848: Statement of William SPICER and Lucretia SPICER relative to Hasty and Daniel two negroes willed by Saml. DELOCH do make the following statement. Said negroes was willed as they have always understood for the support of sd. Lucretisha in her lifetime and at the death of sd. L. and William the said negroes was to be divided between Jessee DELOCH'S heirs and Polly INGRAM'S heirs. The possession of said negros remained with us about 15 years during which time Haster had 3 children named Charles Toney and Hardy. William SPICER swapped Hester and two children (Toney and Charles) in about 1823 to George SMITH for a boy named Isaac ... Henry SMITH'S store.... Hardy was morgaged to William MCGREGOR ... he was drowned. He sold Daniel to William MOORE who is now dead. Daniel has also been drowned....
1848 Sept. 28 - Answer of Henry F. SMITH says that the will names negroes Daniel and Hester ... cannot therefore admit that the said Samuel DELOACH devised the negro woman Hasty to the children of Polly and Jessie.... He has been informed that a great many years before the death of Samuel DELOACH the said Tracey intermarried with her husband and that upon the marriage DELOACH gave her a small girl, then not more than 7 or 8 years old, that Tracy raised the girl to womanhood, when she gave birth some one or more children older than (blank) Hasty and Daniel long before the making of the will.... Spicer sold the mother of Hasty and Daniel with the knowledge of Samuel DELOACH.... SMITH explains how he became the owner. Sometime in the years 1819 or 1820 his father exchanged a negro boy and perhaps one or two small children for the woman Hasty with William SPICER.... Sometime in the year 1833 the father of complainant departed this life. In the division of the estate of his father the negro woman Hasty and three of her children were alloted to Martha SMITH the sister of respondent. That sometime thereafter Martha intermarried with one Ross WEBB who thereby became the owner of Hasty and her three children and that some time in the year 1837 respondant bought Hasty and three children to wit Jane, Paralee, and Houston ... and he bought with them a negro man the husband of Hasty.... Hasty has had some 18 or 20 children but cannot tell the precise number. Respondant has the woman Hasty and nine of her children to wit, Jane, Paralee, Houston, Leonadas, Hannah, Harriet, John, Tabby, and Jacob. Five she has had since he bought her and the last Jacob he bought from his brother Samuel SMITH the boy was then some 12 years old....

Samuel DeLoach, by his last Will and Testament dated 29 Oct. 1805, bequeathed to his daughter Lucretia "Tracy" DeLoach Spicer and her husband William Spicer two of his slaves named Daniel and his sister named Hasty. At about the same time, he loaned his slave named Jenny, who was the mother of Daniel and Hasty, to his daughter Tracy Spicer. Descendants of the DeLoach and Ingram families became inbroiled in a series of law suits concerning the slaves Jenny, Daniel and Hasty and their children. Hasty and Daniel had been sold to the Bryant and later to the Smith families in Wilson County, Tennessee.

Jordann Sadler , who is a descendant of Hasty, has done extensive research of her family. The documents that she has found are attached to her ancestor Hasty DeLoach (Hasty Smith).

RUFFIN DELOACH WILL


1st I do will and bequeath that my estate both real and personal shall be kept together for the term of three years after my decease unsold and undivided under the superintendence and management of my hereinafter named executor or my administrators; for the purpose of paying my just debts, with the proceeds there of unless the same be sooner paid.

2nd. I do Will and bequeath that at the expiration of said term of three years, all my real estate, attached to the plantation on which I now reside may be sold at the discretion of my executor or admin' and can junction with my wife ABBA DELOACH and the proceeds there of applied to the payment of such of my debts as may remain unpaid. And that the remainder of the proceeds of said sale [if any] be equally divided between my beloved ABBA and my sons JESSE and JOHN M. DELOACH, but should my executor and my wife ABBA not deem it expedient to sell my aforesaid real estate then, I will & bequeath same to my said wife, ABBA and my sons JESSE & JOHN DELOACH.

3rd. I will and bequeath to my beloved daughter OLIVIA McELRATH all the Negroes Slaves I have heretofore delivered unto her possession together with the increase & no more.

4th I will and bequeath to the children of my deceased daughter ELIZABETH ORR [viz] MARY TRIMLEY ERELINA McNULTY, RUFFIN H. ORR, and WRIGHT B. ORR a certain negro woman named HANNA & her child DENNIS and their increase, to be sold by my executor or administrator on a twelve month credit and the proceeds equally divided amongst them.

5th I will and bequeath to my beloved wife ABBA DELOACH the following named Negroes viz, PATIENCE BALEMAN or BATEMAN, JUPITER SAM and SALLY, to her and her heirs forever and MARGARET & her increase to my son JOHN M. DELOACH.

6th. I will and bequeath to my son JOHN M. DELOACH the following named negroes viz: GEORGE REUBEN, NELL, BEN, NELLY and her two children, HARRY and FANNY & their increase together with my real estate, lying west of JOHN BIRD's entry and south of the Burlin tract.

7th I will and bequeath to my son JOHN M. DELOACH the following named negro slaves viz. LEWIS, TIM, REUBE, ALFRED, PEGGY, CAROLINE & her two children, MARY & SARAH and EDA and their increase together with the tract of land lying between the Clark & Burlin surveys, In trust forever for the following purposes and none other that is to say in trust for the said JOHN M. DELOACH his exs, admins & c, to take care of manage work and apply the proceeds thereof to the maintenance of & support of my son JESSE DELOACH during his natural life and at his decease to transfer and deliver the said property to his several descendants should he leave any, But should my said son JESSE die leaving no issue then & in that case I will and bequeath the said negroes, LEWIS, TIM, RUMBO, ALFRED, PEGGY, CAROLINE, & her two children, MARY & ISAAC and EDA & their increase to my son JOHN M. DELOACH, and my daughter OLIVA McELRATH and their heirs forever, to be equally divided between them.

8th I will and bequeath to my wife ABBA DELOACH and my sons JESSE & JOHN M. DELOACH equally all my farming utensils horses, oxen, stock of cattle hogs & sheep, also my household furniture to them & their heirs forever

9th. I will and bequeath to my great granddaughter MARY ANN McNULTY a certain negro girl slave named SUSAN child of my negro woman CAROLINE

Lastly I do constitute and appoint my son JOHN M. DELOACH sole executor

I RUFFIN DELOACH do make this my codicil to the annexed my last will and testament bearing date the 26th October A. D. 1833 and I hereby change so much of the seventh article of said will as gives the residuary property willed in the trust for my son JESSE DELOACH, to my son JOHN M. DELOACH and my daughter OLIVA McELRATH, and their heirs for ever, and in the event of my said son JESSE DELOACH dieing without lineal descendants, then I do will and bequeath one third of said property to my said son JOHN M. DELOACH, one third to my said daughter, OLIVA McELRATH, and the other third to the heir of my deceased daughter ELIZABETH ORR, and their heirs forever. Secondly. Tracey SPICER during her natural life two negro slaves named Daniel and Hasty and on the death of Tracy and her husband William SPICER shall be vested in the children of said Polly INGRAM, his dau., and son, Jessee DELOACH. They have a copy of the will in Ark. Tracy and her husband received the slaves in N.C., but sometime after her father's death, they moved to Wilson Co., TN bringing with them the two slaves and their increase. Tracy and her husband are still living in Wilson County, but are now very old being something over 70 years of age.... The said girl Hasty has as your Orators are informed, twenty one children, a portion of whom are now in the possession of the defdts. the others have been carried away to other states perhaps.... Henry SMITH has girl Hasty and the following named children of said Hasty, to wit: Jacob, Jane, Paralee, Huston, Leionidus, Hannah, Harriet, John and Tabby - Henry got said Hasty and several of her children from his father, who purchased Hasty and some of the others at the sale. Several children of Hasty have been sold ... one by the name of Charles.... Dr. J.M. SMITH has one of Hasty's children named Lewis, but how he got him cannot state.... Joseph SMITH has in his possession a girl named Emeline a dau. of Hasty and the defdt. Alfred MCCLAIN has a woman by the name of Judy, also a dau. of Hasty and two of said Judy's children, whose names are not known.... Jesse DELOACH, with a family of several children, who have an interest of 1/2 in the said slaves live in the state of Miss ... do not know the names of the children of Jesse. - Bondsmen for Defdts.: James INGRAM, Jorden STOKES, and Robert L. CARUTHERS. 15 Apr. 1848: Statement of William SPICER and Lucretia SPICER relative to Hasty and Daniel two negroes willed by Saml. DELOCH do make the following statement. Said negroes was willed as they have always understood for the support of sd. Lucretisha in her lifetime and at the death of sd. L. and William the said negroes was to be divided between Jessee DELOCH'S heirs and Polly INGRAM'S heirs. The possession of said negros remained with us about 15 years during which time Haster had 3 children named Charles Toney and Hardy. William SPICER swapped Hester and two children (Toney and Charles) in about 1823 to George SMITH for a boy named Isaac ... Henry SMITH'S store.... Hardy was morgaged to William MCGREGOR ... he was drowned. He sold Daniel to William MOORE who is now dead. Daniel has also been drowned.... 1848 Sept. 28 - Answer of Henry F. SMITH says that the will names negroes Daniel and Hester ... cannot therefore admit that the said Samuel DELOACH devised the negro woman Hasty to the children of Polly and Jessie.... He has been informed that a great many years before the death of Samuel DELOACH the said Tracey intermarried with her husband and that upon the marriage DELOACH gave her a small girl, then not more than 7 or 8 years old, that Tracy raised the girl to womanhood, when she gave birth some one or more children older than (blank) Hasty and Daniel long before the making of the will.... Spicer sold the mother of Hasty and Daniel with the knowledge of Samuel DELOACH.... SMITH explains how he became the owner. Sometime in the years 1819 or 1820 his father exchanged a negro boy and perhaps one or two small children for the woman Hasty with William SPICER.... Sometime in the year 1833 the father of complainant departed this life. In the division of the estate of his father the negro woman Hasty and three of her children were alloted to Martha SMITH the sister of respondent. That sometime thereafter Martha intermarried with one Ross WEBB who thereby became the owner of Hasty and her three children and that some time in the year 1837 respondant bought Hasty and three children to wit Jane, Paralee, and Houston ... and he bought with them a negro man the husband of Hasty.... Hasty has had some 18 or 20 children but cannot tell the precise number. Respondant has the woman Hasty and nine of her children to wit, Jane, Paralee, Houston, Leonadas, Hannah, Harriet, John, Tabby, and Jacob. William Bloodworth

Died at his residence in Marshall County, Miss., on
the 24 day of November, 1860, William Bloodworth, at
the advanced age of 82 years. The deceased was born
in Edgecombe County, N.C., emigrated in early life
to Wilson County, Tennessee, thence to Haywood County,
West Tennessee, where he joined the Baptist Church, and
thence moved to the State of Mississippi. He was a
consistent and honored member of the church of his
choice for some twenty-five years. He was an esteemed
citizen of the community in which he lived, and enjoyed
the confidence of all who knew him. His death was, as
his life had been, that of a righteous man. He leaves
an aged companion and several children to mourn his loss.

To the honorable Military authorities of the State of Louisiana, (commanding)

We the undersigned Petitioners respectfully reprisents: that on the 29th day
of June 1862 John W. Stovall, A. G. Colliar (Collier), James Rains, James
Teagle, T. J. Haddox, James M. Haddox, James P. Oliver, John Roberts, Thomas
Cox, Q. A. Hargis, Nathaniel Bolton, Luca Radishic (Radescich), C. A. Meacom,
Phillip Burnstine (Bernstein), Tholmas Millin (Milling), William Howell, John
Dickerson, Benjamin Tedley (Teddlie), Christian James, Dr. Cook, __________
Shoulders (Shoulders), Elisha Martin, all residents of the Parish of Winn,
armed with Guns and Pistols and without any authority formed themselves in to
a mob company & prosceded to the house of William T. Bell and arrested him in
his own dwelling house, and then proseded to T. F. Smith's and from there sent
a squad to J. W. Shumaker's and arrested him and a squad to Bennet J. Boyett's
and murdered the said Boyett a peacable and respectable citizen of the
Parish of Winn in his own dwelling house, and then proseeded to arrest E. H.
Deloach, C. G. Clark and others, all residents of the Parish of Winn and on
the same day marched them under an armed guard to the town of Winnfield and
put them in the Parish Jail and kept them in jail or under an armed guard
untill the fift day of July 1862 during which time the said mob falsely and
malitiously sentenced the said W. T. Bell, T. F. Smith, J. W. Shumaker, E. H.
Deloach, C. G. Clark, to be ironed and sent uner an armed guard to General
Hymans (Hyams) head quarter Arkansas, there to be disposed of as he General
Hymans saws proper, and on the 5th day of July 1862 started the said prisoners
on foot under an armed guard to Camp Jackson treating them very badly and on
the road placed heavy irons on them, the prisoners, keeping them under a heavy
armed guard and continued the march to Camp Jackson and from there to Monroe,
Ouchita (Ouachita) Parish, La., ____________ the said prisoners was put in the
Parish Jail and there kept untill the 7th day of Sept 1862, charging said
prisoners with treason against the Confederit Government, after which the said
prisoners were tried by a Confederit District Court held at Alexandria on the
10th day of November 1862 and nothing being found against them they were
honorably Discharged, after which said case has been laid before the Civil
Court for redress and damages, said Civil Court of the Parish of Winn refused
to give any redress or damages or to bring the murders to justice, therefo we
your Petitioners pray that the aforesaid mobing Party or murders be arrested
and delt with according to law. Your petitioners further pray that ninety
thousand dollars damages be assessed, fifty thousand to Mrs. Fatama Boyett,
the wider of the murdered B. J. Boyett, ten thousand to W. T. Bell, ten
thousand to T. F. Smith, ten thousand to J. W. Shumaker, and ten thousand to
E. H. Deloach. Your petitioners pray that you the said military authorities
arrest the aforesaid mob of murders forthwith as we believe they will abscond
if not arrested.

Simon DeLoach enlisted in the US Army when he was 27 years old on 21 Nov 1814. He served in the 39th Infantry Regiment until the end of his enlistment on 20 Nov 1819. He was discharged from the Army at Fort Scott, Georgia. He received a pension for his service. His enlistment record shows that he was 5' 8" tall, had hazel eyes and sandy colored hair with a fair complexion. Before enlisting, he was a farmer in Pitt County, North Carolina.

In the 1830 Dickson County, TN Census, he is listed as 40-50 years old, with a wife of the same age. They had two children, a son 15-20 years old, and a daughter 5-10 years old.

In the 1840 Dickson County, TN Census, Simon and his wife are 50-60 years old, and their children are 15-20.

There was a marriage in Dickson County on 14 March 1840 between John M. Biter and Jennette March.

On 13 July 1848, Ginette Biter married Simon Deloach. It is assumed that John M. Biter died before 1848.

Gantt & Patterson, attorneys at law, is a strong firm consisting of Col. George Gantt, Col. Josiah Patterson and M. R. Patterson, and was organized in April, 1878, succeeding the firm of "Gantt, Patterson & Lowe." Col. Josiah Patterson is a native of Morgan County, Ala., where he was reared, educated and admitted to the bar in 1859. Upon the breaking out of the late war, he raised, and was made commander of the Fifth Alabama Cavalry, and served with distinction throughout the war. Upon the establishment of peace he opened a law office at Somerville, Ala., where he practiced one year, and then five years in Florence, Ala. In March, 1872, he came to Memphis and was a member of the firm of Patterson & Lowe until the formation of the firm of Gantt Patterson & Lowe, which was terminated in a few months by the death of Mr. Lowe. In 1882-83 Col. Patterson was a member of the State Legislature from this county. He is a member of the order of F. & A. M. His parents were Malcolm and Mary (Deloach) Patterson, natives of Maryland, and were of the famous Scotch-Irish descent. They followed the occupation of farming, and died in Morgan County, Ala., the father in 1859 and the mother in 1875. M. R. Patterson is a son of Col. Josiah Patterson and was born in the State of Alabama in 1861. He was educated in the Vanderbilt University, and afterward studied law with his father, and was admitted to the Memphis bar in 1881. He then practiced alone for one year, since which time he has been a member of the law firm of Gantt & Patterson. On the 24th of February, 1886, he was joined in marriage to Miss Lucile Johnson, a native of this city. He is a member of the F. & A. M. order.

of Sumter, Al. on July 1,1889. Being duly sworn in, Boon stated that when
a private in Co.E of 7th Regiment of N.C. Infantry and while in the discharge
of his duty in September of 1864, near Petersburg,Va. he lost his left
leg. He also state that on the 28th. of February, 1889,he is a resident
of Al. engaged in farming and that his taxable property does not exceed
four hundred dollars in value.


(Research):CAPT. WILLIAM R. DELOACH.

Comrade William R. DeLoach was born June 4, 1842, and reared in Sumter County, Ala., and died in Memphis August 5, 1910 At the age of eighteen DeLoach enlisted as a private in the 5th Alabama Regiment, commanded by Col. (afterwards Maj. Gen.) R. E. Rodes. His service throughout the war was of the very best type. An old comrade once pointed to him. as the only man he ever knew who was absolutely devoid of personal fear. This statement is not literally true. DeLoach's intelligence recognized the hazard of battle, but his true moral courage rose above it. To him "duty" to himself and family and love of country were higher than all else, and made him bear himself as if ignorant of fear. He served with honor in Virginia, being badly wounded at Sharpsburg while climbing over the Federal breastworks, and later on was shot down at Mine Run while voluntarily leading a charge which was the duty of superior officers. He fell at the head of his men, with a jagged hole in the neck, which!
kept him out of the service for three months. Receiving his promotion at his return, he was assigned to Forrest's Cavalry and made captain of a company of independent scouts. Near Decatur, Ala., he was captured and kept on Johnson's Island until July, 1865.

The hardships of war bore lightly upon the youthful soldiers of the South. Their courage was inherited, the strength and joy of comradeship were theirs, and, like their ancestors, they met the foes of their country with inborn steadfastness. It was natural for DeLoach to fight, he had a knowledge of the questions at issue.

But it was after he returned home in 1865 that the real test of manhood came to DeLoach and to the men of his class. How he met this trial is known only to those who touched shoulders and divided counsel with him at that time. From that day till 1873, when the white people of Sumter came into their own again, was the time that tried men's souls in the Southland. From the town of Livingston, DeLoach's home, to the northern boundary of the county the proportion of blacks to whites was larger than in any other county in Alabama. The negroes almost from the first were under the control of aliens and renegades, and the struggle for existence was on in earnest. Reconstruction, with its deliberate plan to subject the native white people to their former slaves, was an unspeakable horror, to be resisted to the death. If the true story of reconstruction in the Black Belt of Alabama should ever be told, DeLoach's name would be written high up on the roll of honor. His judgment and courage were with him under all conditions. When the struggle was over, his kindliness made him resist any cruelty to, or oppression of, the negroes, when control was absolutely in the hands of the whites. He acted steadily upon this principle during his long service as judge, and no court was ever administered more fairly than his. His reelection time after time, making his term of office thirty four years, was a tribute to his integrity and intelligence.

The writer of this sketch states "Of all the men whom I have known and of all the comrades I have loved, DeLoach came nearest the right life, and his surviving friends will join me in this judgment of his character."

In 1867 Capt. W. R. DeLoach was married to Miss Susan Gibbs, a daughter of Col, Charles R. Gibbs, an officer of the War of 1812. Theirs was an ideal union. Will DeLoach and Sue Gibbs loved each other from youth through a long life, and parted only through that inevitable decree which "happeneth to all."

Charles Augustus DeLoach was born in Upson County, Ga. on August 2, 1842 to
Thomas DeLoach and Amelia "Milly" Isabella Magnan. They resided in Upson
County until approximately 1848-49 when they moved to Troup County, Ga. The
family was in Troup County by the time of the 1850 census. When war broke
out, Charles, along with two of his brothers and six first cousins, joined
Hilliard's Legion, Company A, 5th Battalion, Alabama Volunteers and served
under Captain Peter Rowland. As this was a cavalry unit, Charles furnished
his own horse, for which he was paid 40 cents per day. In September, 1862,
Charles was sick with a "fever" and in the hospital in Atlanta. His mother
went to Atlanta to nurse him back to health (and apparently succeeded) but she
contracted the disease and died on the way back home. Her date of death is
listed as October 10, 1862 in the family bible. Charles stayed with his unit
until the wars end and was paroled in accordance with the terms of a military
convention entered into on the 26th day of April, 1865, between General Joseph
E. Johnston, commanding Confederate Army and Major General W.T. Sherman,
commanding U.S. Army in North Carolina. Roll dated Hillsboro, North Carolina,
April 28, 1865, paroled at Hillsboro, North Carolina, May 3, 1865. He was
probably a prisoner of war. He had left home riding his horse but returned
home on foot.
Charles wasted no time after his arrival home (unknown as to how long it took
him to walk home) in courting his sweetheart. On October 7, 1865, he married
Mary Elizabeth Nichols, daughter of William Martin Nichols and Henrietta
Cavendar. According to information passed down through the family, they
eloped thereby upsetting her family so much that they did not speak to them
again until the birth of the first child (which was actually two, twins).
Charles and Mary Elizabeth had a total of 13 children that survived infancy.
Charles was of the Baptist faith and a member of the Masonic Order. He held
many positions during his lifetime. In May 1897, he became the Postmaster.
He served on juries in both Troup County, Ga. and Chambers County, Al. He was
a farmer and storekeeper also and played the fiddle. In later years, he was
the Overseer for the Hugley Farm on State Line Road.

In the 1880 Chambers County, Alabama Census, Thomas is living in the household of his grandson, Thomas Sutton DeLoach.
