The Will of Samuel DeLoach - 1764


Samuel DeLoach was born in Brunswick County, Virginia, in about 1706. He was the son of Thomas DeLoach and Mary _______. In about 1744, he married Mary Boykin, the daughter of Francis Boykin and Millicent Williams. Mary was born in Northampton County, North Carolina in about 1726.

The Samuel DeLoach Will was recorded in Edgecombe County, North Carolina, on 5 April 1764. The following is a transcription of a copy of the original will.


In the Name of God Amen. I Samuell Deloach of Edgecombe County in the province of North carrolinia - being weak in body but of sound mind and perfect memory Make This my last will and testament and make all others heretofore maid by me Void first and principally I Commit my Soul into the hands of God that gave it and my body to the grave be buried in a nice Desant and Christian like manner.

Iprimis. I gave and bequeath to my beloved wife mary Deloach the land that my father in law [appears to have been erased, but looks like "left me in north hampton county"] Francis Boykin left me in northapton County to She her heirs and assined forever - - -

I further gave to my Wife mary Deloach my young black mair and Side Saddle to She and her heirs forever - - -

I leve to my wife mary Deloach the keep of the land and plantan where on I now live and my still and all my nigros for the maiking maintaining and schoolin of my childrin During her life or whiddowhood and then to be devided by my executors according as my Will Derects - - -

I further lend she my wife mary Deloach after my Debts and funral Expences is paid all my house hole goods and Chattles and all my tenements until my childrin comes of Eage and then to be devided and paid out by my ExR's - - according as my Will Dericts -

Item- I gave and bequeath to my Son William Deloach all that part of my estate I possesed him of in my lifetime and ten shillings cash to be paid him by my ExR's to him and his heirs forever

Item- I gave and bequeath to my Darter Averilla Ruffin all that part of my Estate I possed her of in my lifetime and ten shillings cash to be paid her by my ExR's - to she and her heirs forever - - -

Item- I gave and bequeath to my Darter Molley Braswell all that part of my Estate I possed her of in my lifetime and ten Shillings cash to be paid her by my ExR's to she and her heirs forever - - -

Item- I gave and bequeath to my son Jesse Deloach that tract of land that I sirvaid joining of of mosses hairs land and my bay hose Cold Spark and five head of cattle and five breading sows and one feather bead and furnurture which I gave to my son when he comes of Eage to be paid him by my ExR's to him and his heirs forever - - -

I further gave to my son Jesse Deloach after my wife deceas or whiddow hood my Negro fellow Ephram to him and his heirs forever - - -

Item- I gave and bequeath to my Son Samuell Deloach the land and plantation that I purcheased of John Stinson and my Roan mair and five head of cattle and five breading sows and one feather bead and furnurture Which I gave to my son When he coms of Eage to be paid him by my ExR's - to him and his heirs forever - - -

I further gave to my Son Samuell Deloach my Negro fellow Tony after my wifes deceas or whiddow hood to him and his heirs forever - - -

Item- I will and bequeath to my Darter Selah Deloach five head of cattle and one feather bead and furnurture Which I gave to my Darter when she coms of Eage tp be paid by my ExR's to she and her heirs forever - - -

Item- I gave and bequeth to my Son John Deloach the land and plantation that I purchased of John Stringer and my mair cold ?? and five had of cattle and one feather bead and Ten [appears to have been erased] and five breaing sows which I gave to my Son when he coms of Eage to be paid him by my ExR's to him and his heirs forever - - -

I further gave to my son John Deloach my negro fellow Dick after my wifes deceas or whiddow hood to him and his heirs forever - - - -

Item- I gave and bequeth to my Darter Millie Deloach five had of cattle and one feather and furnurture which I gave to my Darter when she coms of Eage to be paid her by my ExR's to she and her heirs forever - - -

Item- I gave and bequeath to my Son Solomon after wifes deceas or whiddow hood the land and plantain whereon I now live with my Still and negro Garl Luce to him and his heirs forever - - -

I gave my my negro wentches jan and pat thea and there increase after my wifes deceas or whiddowhood to be Equally Devide between my fore Darters Averilla Ruffin and Molley Braswell and Selea Deloach and Mille Deloach - - - - which I gave my Darters to them and their heirs forever -

And my Will and Desire is that after Debts and funeral expenses is paid that the Remainder of my Estate let it be of What Nature or Kine Soever it will that my wife Shall have the gaveing and Despersing of it to my Children as she sees fit - - - -

And Lastly I do appoint my wife mary Deloach and my Sons William Deloach Jesse Deloach and Samuel Deloach my hole and soule Executors of this my last Will and Testament
