The Will of Samuel DeLoach, Jr. - 1805


Samuel DeLoach, Jr., the son of Samuel, Sr. and Mary Boykin DeLoach, inherited his father's land and plantation in Edgecombe County, North Carolina. In about 1765, he married Jerusha ________. His will was made and signed on 29 October 1805.

Following is a transcription of that will that was made by the Department of Archives and History, Raleigh, NC, on 22 March 1977. A copy of the will is available at the Johnston County Court House in Wills, 1760-1830, Volume 801-1, Page 59.


Samuel DeLoach Will - 1805


In the name of God Amen. I Samuel Deloach of the County of Johnston and in the state of North Carolina being very sick but of sound mind and memory and calling to mind the mortality of my body and knowing it is appointed for all men to die do make and ordain and publish this to be my last Will and testamant Hereby revoking and making void all wills by me heretofore maid. First, I give and recomment my Soul to God my Creator, my body to be decently buried at the discretion of my Executory. And as to the worth estate it has pleased God to bless me with, after my just debts are paid, I give devise and dispose of in manner form following, that is to say,

Imprimis--I lend my beloved wife Jarusha during her natural life six negroes Tony, Bob, Jude, Easter, Lewis, & Ned also a sorrel mare called Fancy, two feather Bed, and furniture and all my kitchen furniture & two Cows and calvs which loan I shall hereafter dispose of to my Children.

Item. I give and bequeath to my son Joseph twenty five pounds.

Item. I give and bequeath to my son John five Shillings.

Item. I give and bequeath to my daughter Treacy (Spieir) during her natural life two negroes Daniel and Hasty which negroes after her death and the death of her husband I give to be equally divided between the heirs of my son Jesse and daughter Ingram.

Item. I give and bequeath to my son Jesse all the property I have heretofore put in his posession.

Item. I give and bequeath to my son Samuel after the death of my wife one negro woman and child(viz) Jude and Ned also one gray mare and two Cows and Calvs to him and his heirs.

Item. I give and bequeath to my son Solomon after the death of my wife two negroes Bob and Lewis and a bay filly Called pigeon to him and his heirs.

Item. I give and bequeath to my daughter Polly Ingram two negroes Hannah and Diner and one Cow and Calf to her and her heirs.

Item. I give and bequeath to my two grandson's Sandy and William fifty Dollars each to be paid them by the Executors when they come of age.

Item. All the residue and remainder of my property not given away to be equally divided among my children.

And lasty I appoint my son Solomon and Osburn Hunter my Executors of this my last will and testament hereby again revoking and declaring void all other wills by me made.
