The Will Of Mary Boykin DeLoach


Mary Boykin, the daughter of Francis Boykin and Millicent Williams, was born in Northampton, North Carolina, in about 1726. In about 1744, she married Samuel DeLoach, born in 1706 in Bruswick County, Virginia. Samuel inherited the Estate of his father, Thomas, located in Edgecombe County, North Carolina, where he and Mary lived for the remainder of their lives. The wills that he and Mary left indicate that they were a prosperous family. Following is Mary's will, recorded in Edgecombe County in 1773. A copy of her beautifully hand-written will is still available from the Edgecombe County Court House.


Mary DeLoach Will - 1773

In the Name of God amen. I Mary Deloach of Edgecomb County in the Province of North Carolina, being weak in body But of Perfect Sound mind & memory do make & ordain this my last will & Testament, and make all other wills made by me void.

Inprimis. I give & Bequeath unto my Son William Deloach. his heirs and assigns the Sum of five Shillings virginia money to be paid him by my Executors

Item I give and bequeath unto my daughter Averilla Ruffin, wife of Richard Ruffin the Sum of five shillings virginia money to She her heirs & assigns for Ever to be paid By my Executors.

Item I give and Bequeath unto my Son Jesse Deloach all that part of my Estate that I possessed him of in my Lifetime and also the sum of five Shillings virginia money to him his heirs & assigns. forever. to be paid him by my Executors.

Item I give & Bequeath unto my Son Samuel Deloach all that part of my Estate that I possessed him of in my Lifetime and also one cow & calf & two Ioes & Lams to him his heirs & assigns for Ever, to be paid him out of my estate.

Item I give & Bequeath unto my daughter Selah Barnes all that part of my estate that I possessed her of in my lifetime and also the Sum of five Shillings virginia money to She her heirs & assigns forever to be paid hur By Executors out of my Estate.

Item I give and Bequeath unto my Son John Deloach three hundred and twenty acres of land to wit it being part of a larger tract of Land that I purchased of Solomon Boykin.
and also
my great Desk and Square walnut table and peainted Chest and Largest Linin Wheel and gray Mare Cold fly & Black horse cold Dearick and twenty pounds of feathers & thirty head of geese to him his heirs and assigns for Ever.

Item I give and Bequeath unto my Daughter Milley Bloodworth all that part of my Estate that I possessed hir of in my Lifetime and also my Wareing close and my Sidesaddle to she hir heirs & assigns for Ever.

Item I give and Bequeath unto my Son Solomon Two beds & furneture and the Smallest Desk and pinetable and case of Bottles and Five head of Cattle and Five Breadin Sows and one Black mare Cold fly and young horse (lined out word Cold) Cold Sharper and five pound pro(character that looks like a backward S) to be paid him out of my estate to him his heirs and assigns for Ever.

Item I give and Bequeath unto my granson William Brasswell five Shillings virginia money to him his heirs and assigns forever to be paid by Executors out of my Estate.

Item It is my Will and desire that after my debts & funeral Expenses is paid that the remainder part of my Estate be equally Devided Between Two of my Sons, to wit. John Deloach and Solomon Deloach. and it is also my will and Desire that William Bloodworth and Elijah Horn with any other two persons that my afores Sons John Deloach & Solomon Deloach will chuse divide the Estate Equally between my two afors Sons John DeLoach & Solomon Deloach Which I give & Bequaith Samuel Deloach & John Deloach to be Executors of this my Last Will & Testament in Witness there of I do hear unto set my hand & Seal this Forth day of January one thousand Seven hundred and Seventy three.

Edgecombe Co. April Court 1774. The will in Wile was in Open Court exhibited by the Exors and proved by the Oaths of John Faulk & Hanah Faulk two of the subscribing witnesses there to and at the same time the Exors there in named was qualified according to Law and rec that the same.
