MADISON E. DELOATCH WILL

      I, Madison E. Deloatch of the County of Northampton and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner and form following what is to say

      First- That my Executors thereinafter named shall provide for my body a decent burial suitable to the wishes of my relation and friends, and pay all funeral expenses, together with my first debts, howsoever and to whomsoever owning, out of the money that may first come into his hands as a part or parcel of my estate.

      Item- I give and devise to my beloved sister Martha A Edwards my boy Allen to have the term of her natural life and then to her lawful heirs in free simple.

      Item- I give and devise to my beloved brother William J Deloatch my negro woman Fanny and Allis the term of his natural life and then to his heirs if he has any and if not then for them to be equally divided between Martha A Edwards and Augustus R Deloatch heirs in free simple.

      Item- I give and devise to my beloved brother Augustus R Deloatch heirs my negro woman July and Henrieta, for the term of their natural life in free simple.

      Item- I give and devise to my niece H.S. Edwards my gold watch chain and Trunk for the term of her natural life in free simple.

      Item- I give and devise to my nephew Richard M Edwards my double barrel gun for the term of his life in free simple.

      Item- My will desire is that all the residue of my estate if any after taking out the devises and legacies above mentioned shall be sold and the debts owning to me collected and there should be any surplus ever and above the payment of debts, expenses, and legacies that such surplus shall be equally divided and paid to my said brothers and sister in equal proportions share and share alike to them and each and every of them.
Their executor, administrator and assigns absolutely forever

      And lastly. I do hereby constitute and appoint my trusty brothers Britton Edwards and William J. Deloatch my lawful executors to all intents and purposes to execute this my last will and testament, according to the true intent and meaning of the same every part and clause there of thereby revoking and declaring utterly void all other wills and testament by me therebefore made.

      In witness whereof I the said M. E. Deloatch do there unto set my hand and seal this 12 day of January AD 1863.

Signed, sealed, published and declared by the said Madison E. Deloatch to be his last will and testament in the present of us, who at his request and in his presence do subscribe our names as witnesses thereto Witnesses J. Deloatch H. S. Knitton

Northampton County Sept. Court 1864. A paper writing purporting to be the last will and testament of Madison E. Deloatch, deceased in exhibition for Probate in open court by Britton Edwards, and William J. Deloatch the Executors, therein named and the due executor thereof by the said Madison E. Deloatch is proved by the oath and examination of James J Deloatch and H.J. Britton and two subscribing witnesses thereto. It is therefore considered by the County, thus the said proper writing and every part thereof is the last will and testament of the said Madison E. Deloatch and the same is ordered to be recorded officially and thereupon the said Britton Edwards owe of the Executor the named renounced by right to qualify as Executor and thereupon this said William J. Deloatch the other executer therein named, qualifies as executor aforesaid and by taking the past prescribed by law.
