The Will Of John T. Deloatch

JOHN T. DELOATCH WILL

In the name of God Amen!
      I, John T. DeLoatch of the county of Northampton in the State of North Carolina, being of sound and dispensing mind and memory but conscious of the uncertainty of my earthly existence to make publish and declare the following to be any last will and testament, revoking any and all other heretofore made by me.

Item First
      I loan unto my beloved wife Kisziah during her natural life, my home tract of land containing about three hundred and ninety-six acres, all of my household and kitchen furniture, except a bed to each of my children, as many mules, horses, cattle and hogs as may be necessary to stock her farm to the selective by her, and I give her absolutely one year sufficient for herself and family and the privileges during life of being supplied with brewed corn and flour out of my will.

Item Second
      I give devise and bequeath to my son Robert H. Deloatch my tract of Land known as the “Old Place” containing about twelve hundred and twenty six acres to him and his heirs.

Item Third
      I give devise and bequeath to my son Knew bourn S. Deloatch my tract of Land known at the “Loss Tract” containing about eight hundred and seventy eight acres and on half of my Mill situated near said farm to him and his heirs.

Item Fourth
      I give devise and bequeath to my daughter Mary W. Vinson one half of the Mill to her and her heirs.

Item Fifth
      All the balance of my lands including the hence tract loaned to my wife. I give devise and bequeath to my daughter Elizabeth T. Deloatch Mary W. Vinson and Eliza B. Deloatch to them and their heirs.

Item Sixth
      It is my desire to make an equal division in value among my children and I therefore direct that my land shall be valued by three competent and disinterested to be selected by the Judge of Probate or Judge of the Superior Court of Northampton County and if it is determined by such evaluation that the share or shares desired to any one of or more of my said children is greater than one fifth in value of all my lands, then the child or children to whom such share or shares is desired shall account for the excess in value to the child or children having left their one fifth in value and the sum of money so changed shall be a lien upon the land upon which it is changed.

Item Seventh
      All the residue of my property and estate of every kind and descriptions I give devise and bequeath to my five children Elizabeth T., Mary W, Robert H., Knew bourn S, and Eliza B.

Item Eighth
      Should any one or more of my children die without leaving lawful issue then the share of my property given to each child or children shall go the survivors and to the child or children of such as may, be dead, the child or children of my deceased child to represent the ancestor and to take such share or unveil the ancestor of living.

Item Ninth
      I authorize and empower my execution here in after named to self such portion of my perishable estate as their may think proper either for cash or on a credit.

Item Tenth
      I nominate and appoint my friends William Barrow and James H Vinson Executers to this my last will and testament. In witness I have here write sit my hand and seal this the 28th day of August 1869.

I, John T. Deloatch of Northampton County make publish and declare the following as a codicil to my last will and testament. Namely, the Mill where I purchased of Dorsey S. Deloatch and wife known as Gravely Mill I give devise and bequeath to my wife and to my children Robert H., Elizabeth T. and Eliza B. with the understanding that it is to be valued with my other lands and the value is to be accounted for in the division of my estate as is provided for in my will and is to be subject to the same provision as my other land in the event either of my said children should die without lawful issue.

Item 2. I give to Peter Deloatch my former servant forty acres of land known as the Jethro Sykes land.

Item Third. I give to Ella Deloatch my former servant two acres of land lying after the Wild Cat Swamp and West of the Jethro Sykes tract.

Item Fourth. I give to Peggy Deloatch my former servant two acres of land lying on the Wild Cat Swamp and adjusting that given to Ella Deloatch.
Given under my hand and seal this the 4th of Sept. 1869.

Know all men by these presents that I Kisziah Deloatch widow of John T. Deloatch deceased of Northampton N. Carolina do hereby consitutue and appoint David A. Barnes my lawful attorney for me in my name to cause my dissent to the last and testament of my deceased husband to be entered of record in the Probate Court of said County.

Given under my hand and seal this the 3rd day of January 1870.

On the 10th day of January 1870 Kisziah Deloatch widow of John T. Deloatch in her own proper person appears in the Probate least and causes her dissent to the last will and testament of the said John T. Deloatch to be entered of record which is accordingly done.
