The Will Of Jesse Deloach

JESSE DELOACH WILL

      I, Jesse Deloach of the County of Northampton and State of North Carolina being of sound mind and memory considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner and form following that is to say:

      First- that my executor (herein after named) shall provide for my body a decent burial, suitable to the wishes of my relations and friends and pay all funeral expenses together with my just debts howsoever and to whomsoever owning out the money that may first come into his hands as a part or parcel of my estate.

      Item 1st- I give and desire to my eldest son Henry Deloach one tract or parcel of land containing two hundred and forty five acres and known by the name of the Murrel place also the following negro slaves one negro boy by the name of Green, one negro woman named Sarah and her three children Jim, Julia, and Erosmiss and their increase and on Grey Home to have and to hold to him and his heirs in fee simple forever,

      Item 2nd- I give and desire to my son Dorcy Deloach one tract of land known by the name of the Randolph Tract containing by estimation fifty acres also seventy two and quarter that that purchased of Zachius Martin and forming the Randolph place also the following negro slaves, one negro man by the name of Drew, one negro woman by the name of Milly, her two children Hagar and Mason and their increase also one corralled horse to have and to hold to him and his heirs in fee simple forever.

      Item 3rd- I give and bequeath to my son Jesse Deloach the tract of land on which I now live containing by estimation three hundred and fifty acres be the same more or less also the following negro slaves one negro man by the name of Harry, one negro woman by the name of Tempey and her two children Marice and Allen and Peter and thus increase also one cream colored man to have and to hold to him and his heirs in fee simple forever.

      Item 4th- I give and bequeath to my eldest daughter Martha Deloach one feather bed and furniture the first choice of my bed, one blue chest first choice of my chest, and I also lend to my daughter Martha Deloach one negro boy by the name of Jordan, negro man Allen and negro woman Penny during her natural life and after the decease of my daughter Martha Deloach I give and bequeath the above named negroes, boy Jordan, Allen and Penny to my four sons named Henry, Dorcy, Jesse and my youngest son William Carter to be equally divided among them and their heirs forever.

      Item 5th- I give and bequeath to my daughter Mary Ann Frances Deloach the sum of fifty cents to have and to hold to her and her heirs forever in fee simple.

      Item 6th- I give and bequeath to my youngest son William Carter Deloach one negro slave by the name of Sam, one by the name of Jacob, Edmund, Arthur, Jack and others to have and to hold to him and his heirs forever
and my will and desire is if my son William Carter Deloach should die before he arrives to the age of twenty one years then the above named property I have given to him shall be equally divided between my three sons Henry, Dorcy and Jesse.

      Item 7th- My will and desire is that the balance of my negroes after taking out the above desires and legacies shall be equally divided between my four sons Henry, Dorcy, Jesse and William Carter to have and to hold to them and their heirs in fee simple forever.

      Item 8th- My will and desire is that my daughter Martha Deloach may move in with my son Jesse Deloach and keep her negores with her if she thinks proper to do so other wise she is as liberty to choose his a home and keep her negroes with her or him there out is she thinks proper as my will and desire is for the property I have loaned her to remain in her possession for a support for her during her life time.

      Item 9th- My will and desire is that all the residue of my estate taking out the above legacies and desire above mentioned shall be sold and the debts collected that’s owing to me and if there should be any surplus over and above paying off the debts, expenses and legacies such surplus shall be equally divided between my four sons Henry, Dorcy, Jesse and William Carter share and share alike to them and each and every of them their executor and assigns absolutely forever.

      And lastly- I do hereby constitute and appoint my trusty friend Dr. Alfred Eldridge my lawful executor to all intent and purpose to execute this my last will and testament, according to the true intent and meaning of the same and every part and clause thereof hereby revoking and declaring utterly void all other wills and testaments by me heretofore made. In witness whereof I the said Jesse Deloach do hereunto set my hand and seal this 26th day of April A.D. 1843.

by the said Jesse Deloach to be his last
will and testament, in the presence of
us who at his request and in his presence
do subscribe our names as witnesses thereto.

Northampton County June Court 1844 the forgoing paper writing was exhibited in open court as the last will and testament of Jesse Deloach die and duly proven by the oath of Holliday Hayley and Goodwin B. Harrison the subscribing witnesses thereto and names to be certifies and recorded and the executor there is named having moved beyond the limits of the state administration with the will announced and granted to Kinchan Peele who entered into bond with Nathaniel Allen and Henderson S. Martin as securities in the sum of twenty five thousand dollars, and was qualified as the law directs.
