- I, F. Marion Hyder being of sound mind & memory, do make this my last will & Testament, hereby revoking any Will or part of will, by me at any time made.
First: I commend my Soul to God Who gave it.
Second: I desire my funeral espences paid out of any money I may die in possession of; or that may first come into the hand of my executor.
Third: I give all my household & kitchen furniture to my beloved wife Martha, & that the remain in possession of my dwelling house, garden & orchard, (as stipulated in Deed to A. H. P. Hyder my son) during her lifetime. Provided she does not marry again.
Fourth: I have already given Louisa F. Williams my daughter $50.00 dollars worth of land by Deed; I also give her twenty acres more, joining the lands of D. S. Williams her husband, known as old rockey field running up west side of Pat Branch & joining Oscar A. Hyder on the west.
Fifth: I give & bequeath to my daughter Ladora M. Hart twenty five acres land in addition to land already deeded to her South-East of Louisa F. Williams on west side of Pat's Branch: provided she does not mistreat or abandon her girls Flossie & Winona.
Six: I give & bequeath to my son Robert D. Hyder in addition to land already made to him by Deed: fifty acres of alnd South-East of Ladora M. Hart's on West side of Pat's Branch if enough on that side. Then if not enough on the West of Branch take enough on East side to make said amount.
Seventh: I give to my daughter Beulah A. Hyder fifty acres of land beginning at the old white oak corner, across to Thos. McKinney's, & up Pat's Branch on East side of same, to near the "Caraway Lot" including the house, & out building where E. A. Phillips now lives, & subject to her dowery.
Eighth: I give & bequeath to my daughter Susan Belle Humphreys fifty acres of land on East side of Pat's Branch joining Beulah A. Hyder's land on south side of same, running up about the "Britt Lot".
Ninth: I give & bequeath to my son, A. H. P. Hyder in addition to the land I have already given him by deed the remainder of land on East side of Pat's Branch not already given joining the land of Susan Belle Humphreys.
Tenth: I give & bequeath to my son Oscar A. Hyder the tract of land beginning at the South end of old rockey field on two black gums: running East 17 poles: then to top of mountain all on west side of ridge, & mountain: containing about 40 acres.
Eleventh: I also give to my wife, Martha Hyder, one horse, or mare & spring wagon: if I have them at my death.
Twelfth: I give to my sons, Robert D. Hyder & A. H. P. Hyder all my farming impliments, machinery & tools, two horse wagon & blacksmith tool: equally between them.
Thirteenth: I desire what ever property not mentioned in this will, to be sold, & the proceeeds applied to whatever debts I may owe: then balance divided.
Last: I appoint Robert D. Hyder, & A. H. P. Hyder my executors, of this my last will & testament: & that they may serve without security to bond.
